PLEASE READ THIS AGREEMENT CAREFULLY. IT SETS FORTH THE LEGALLY BINDING TERMS AND CONDITIONS GOVERNING YOUR USE OF THE HYPERMOBILE MOBILE APPLICATION, WEBSITE, AND ANY OTHER RELATED SERVICES OR CONTENT (COLLECTIVELY, THE “INTERFACE”). BY ACCESSING OR USING THE INTERFACE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE (THE “TERMS”).


IF YOU DO NOT AGREE WITH ANY PROVISION OF THESE TERMS, YOU MUST NOT ACCESS OR USE THE INTERFACE.


1. Acceptance of Terms

1.1. Contractual Relationship. These Terms constitute a binding contract between you (“you,” “your,” or “User”) and HyperMobile (operated by [Your Company Name, e.g., Hyper Mobile Tech LLC]) (“HyperMobile,” “we,” “us,” or “our”).

1.2. Additional Policies. These Terms incorporate by reference our Privacy Policy and any other supplemental terms (collectively, the “Policies”).

1.3. Updates to Terms. We may revise these Terms at any time. All changes are effective immediately upon posting. Your continued use of the Interface following the effective date of revised Terms means that you accept and agree to the changes.

1.4. Legal Compliance. You are solely responsible for ensuring your use of the Interface complies with all applicable laws and regulations.


2. Definitions

- “Digital Assets” means cryptocurrencies, tokens, or other digital mediums of exchange.

- “Self-Custody Wallet” means a wallet for Digital Assets controlled exclusively by you, not by HyperMobile.

- “Interface” means the HyperMobile mobile application and related user interface.

- “Supported Network” means any blockchain network the Interface supports (e.g., Hyperliquid, Solana, Ethereum).

- “Gas” means the fee required to execute a transaction on a Supported Network.

- “Third‑Party Services” means any software, products, or services that are not provided by Lootbase but that you may access via the Interface, including decentralized protocols, liquidity pools, oracles, or fiat on‑ramps.


3. No Custodial or Fiduciary Duties

3.1. Non-Custodial. The Interface is purely non-custodial. HyperMobile never takes possession, custody, or control of your Digital Assets, private keys, or seed phrases.

3.2. No Financial Intermediary. HyperMobile is not a bank, broker-dealer, exchange, or investment adviser. We do not provide trading execution, order matching, or act as a counterparty in any transaction.

3.3. No Investment Advice. All information provided through the Interface is for informational purposes only and is not financial advice. Your trading decisions are your sole responsibility.


4. Eligibility & Restricted Jurisdictions

4.1. Age. You must be at least 18 years old.

4.2. Prohibited Jurisdictions. You may not use the Interface if you are located in a jurisdiction subject to comprehensive U.S. sanctions (e.g., Cuba, Iran, North Korea, Syria, Crimea) or where your use would be illegal.


5. User Responsibilities

5.1. Wallet Security. You are solely responsible for maintaining the confidentiality and security of your Self-Custody Wallet credentials, private keys, and seed phrases. Loss of these may result in irreversible loss of assets.

5.2. Transaction Verification. You are responsible for verifying all transaction details (address, amount, fees) before broadcasting. Transactions on the blockchain are irreversible.

5.3. Taxes. You are solely responsible for any taxes resulting from your use of the Interface.

5.4. Fees. You are responsible for all network Gas fees. HyperMobile may also charge separate service fees, which will be disclosed within the Interface.


6. Risk Disclosures

Using the Interface involves substantial risk. You acknowledge and accept risks including, but not limited to: market volatility, smart contract vulnerabilities, network congestion or attacks, protocol exploits, slippage, liquidation of leveraged positions, and uncertain regulatory landscape. Digital Assets are not insured.


7. Prohibited Conduct

You agree not to use the Interface for any illegal activity, sanctions violations, fraud, market manipulation, or to breach the security of the Interface or any related system.


8. Intellectual Property

All rights, title, and interest in the Interface are the exclusive property of HyperMobile or its licensors. We grant you a limited, non-exclusive, revocable license to use the Interface for lawful purposes.


9. Disclaimer of Warranties

THE INTERFACE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.


10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HYPERMOBILE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR DIGITAL ASSETS, ARISING OUT OF OR RELATED TO YOUR USE OF THE INTERFACE. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED USD $100.


11. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of [State, e.g., Delaware], without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Interface shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
